TEACHMIX Terms and Conditions

Our Agreement

Although we tried to avoid it, our lawyers told us there was no way we could be in business without setting out the terms of this agreement. This agreement is a legal document which sets out your rights and obligations, and those of Teachmix, in relation to the fantastic services offered by us through this site or any of the other Teachmix sites to which we link.

Effect of this agreement

Viewing of the Teachmix site itself is free; but when you register for the site, you agree to the terms of this agreement, and you re-affirm that agreement every time you use the Teachmix services, so we recommend you read this agreement so you know what you're getting yourself into.

Applicable law

Teachmix is a company registered in England, and every sale, shall be deemed to be performed in England.

English law shall govern each transaction, including (without limitation) all contractual and other relationships, which arise as a result of such sales. You and we submit to the non-exclusive jurisdiction of the English courts in relation to any disputes arising out of any sale.

Making a contract with us

In return for the excellent service we will give you, we ask that you agree to register for Teachmix sales using your correct name, address and any other requested details. You may be asked to enter credit, debit or charge card details. You must ensure that (a) you are fully entitled to use that card at the time when you provide those details to Teachmix, and when you use the card, and (b) the card has available funds to cover all charges incurred on it in the course of buying from us. If any of the information you enter becomes incorrect or is superseded, then please notify us with the corrected information immediately.

In any event, to register for Teachmix services, you must legally be able to enter into contracts for goods and services that you may buy here. Generally, this means that you must be at least 18 years old and sane.

Misuse of our site

Don't mess with us. Teachmix reserves the right to suspend or terminate any members accounts which, is, or appears to us in our absolute discretion, to be, in breach of any of the provisions of this agreement.

Tax & Duties

We will reluctantly have to charge VAT on all goods and services where applicable. And if you want your purchase to be delivered outside the European Union, you will automatically be responsible for paying all applicable duties. Sorry!

Corrections

You may think we are just making this stuff up but in fact, descriptions of goods and services included in the Teachmix site are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them.

Copyright

You accept that the images and designs used on the Teachmix website are the property of Teachmix or their respective copyright owners, and are used by Teachmix pursuant to express authorization from copyright owners or their agents. You acknowledge that all copyright, trademarks and other intellectual property rights in and relating to Teachmix are vested in Teachmix or our partners where appropriate. You must not use, reproduce, modify or distribute our images or any part of those images in any manner, whatsoever. Not only will this make us throw our toys around but, in the event that there is any dispute between us in relation to this issue, you agree that until the matter is resolved, an interim injunction will be an appropriate remedy. An Interim injunction is a court order, which would prevent any further use or distribution of the image that we are concerned about, until a final court hearing where the court will make a decision on all the facts.

Loss

Please be aware that we will not be liable to you or any third party for any indirect or loss or damage, or for any loss of data, profit, revenue, business or management time, howsoever caused.

This does not affect your statutory rights as a consumer.

Consequential Loss

In the event of consequential loss, Teachmix can only be responsible for the cost of your order.

Negligence

Nothing in this agreement limits Teachmix's liability for personal injury or death resulting from our negligence.

Reasonable Control

Teachmix shall not be liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control. Without limiting ourselves here in any way, we were thinking of a hand of God, or alien invasion.
Changes to this Agreement

Teachmix reserves the right to change the terms of this agreement from time to time, and post a new version on our website. The new version will take effect from the day of posting on the site. Price and availability information are also subject to change without notice.

Severability

In the event that any term of this agreement is held to be unenforceable or invalid by judicial decree or decision, the remainder of this agreement shall remain valid and enforceable.

Security and Privacy

As you're concerned about security and privacy. We want to reassure you that any information you give us during the registration or ordering process as well as any that we know about you by other means will be well protected. We also feel it is important that you know exactly how any information you give us is used and that all information is collected lawfully and in accordance with the Data Protection Act 1998.

How we use your data

The privacy policy forms part of the agreement between us, and by purchasing goods from our site, you agree to be bound by the terms and conditions of the agreement between us. You also give your consent to the way we may handle your personal data in the way stated in this policy statement. Teachmix will not use this data, or disclose it to any other party, either during registration or at any other time, without your express permission, given during registration or at some other time.

We may also contact you in respect of special offers or competitions, but only if you have elected to receive this by checking the opt-in box during the registration procedure or competition entry page, or entered your email address on the home page mailing list submission.

To provide a service that meets our customer needs, we may collect personal data relating to the popularity and usage of particular aspects of the site or related Teachmix sites. However this data will be used or aggregated only on an anonymous basis.

How we protect your data

Any credit card information you give us will be held at a secure and separate site, and once we have authorised your purchase, we will delete part of the number and details, so that even in the highly unlikely event that our site security was breached for any reason your credit card details would be unusable.

Availability Of Goods You Order

If Teachmix has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and any sum debited by Teachmix from your credit card will be re-credited to your account and Teachmix will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. Teachmix will not be obliged to offer any additional compensation for disappointment suffered.

Delivery Of Goods To You

a. Teachmix will post, or arrange a courier on your behalf for, the goods ordered by you to the person and address you give Teachmix at the time you make your order. The consignee (i.e. the person to whom the consignment is sent) will be the declarant and importer into the country for which the consignment is destined. For non-UK destinations, the consignee will be responsible for both customs clearance and payment of customs duties and local taxes where required. Each item ordered will be treated as a separate sale and will be shipped and paid for separately.
b. Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of dispatch of the order. All delivery times quoted on the web site are estimates only, based on availability, normal processing and delivery companies.
c. You will become the owner of the goods you have ordered when the goods are dispatched to you from our premises.

Customs charges

If you are ordering goods for delivery outside of the UK, please note that your consignment may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by you. It is accepted by you that Teachmix has no control over additional charges in relation to customs clearance. Teachmix recommend that you check with your local customs officials or post office for more information regarding importation taxes / duties that may be applicable to your on-line order. You will be the importer of record and responsible for any import VAT and duty that may be borne. In addition, any charges for import clearance will be borne by you, the customer.

Liability

This is as follows:

a. If the goods Teachmix delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Teachmix shall have no liability to you unless you notify Teachmix in writing at the Teachmix contact address of the problem within 10 working days of the delivery of goods in question.
b. If you do not receive goods ordered by you within 30 days of the date on which they were dispatched to you, Teachmix shall have no liability to you unless you notify Teachmix in writing at the Teachmix contact address of the problem within 40 days of the date on which the goods were dispatched to you.
c. If you notify a problem to Teachmix under this condition, Teachmix's only obligation will be, at its option:- to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question to the original method of payment.
d. Teachmix will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to Teachmix under this condition and Teachmix shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph (c) above.
e. Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit Teachmix's liability to you for any death or personal injury resulting from its negligence.
Nothing in this contract creates any right, which is enforceable by any person who is not a party to the contract.

Force Majeure


Teachmix shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
Invalidity
If any part of these conditions is unenforceable (including any provision in which Teachmix excludes its liability to you) the enforceability of any other part of these conditions will not be affected.

Shipping

Each item on your order will be charged and shipped out to you separately, as soon as it is available in our warehouse.
Please ensure that your shipping address details are correct, as they are used exactly as inputted by yourself when submitting your order. We are not responsible for orders with incorrect or missing information should they not reach you.
You have a choice of Shipping Methods, and the following delivery times can be used as a guideline and will depend on stock availability.

UK Standard Delivery:

This will be dispatched with free delivery via Standard UK Mail. We would advise that packages usually sent by this method are received within 2-5 working days from dispatch.
UK Royal Mail Special Delivery:

This method is fully secure and we can track and trace the order for you. Orders placed by this method should reach you on the following working day, though there may be delays. We will endeavor to ensure that goods leave our fulfillment centre on the day the order is received, providing the item is in stock or on the same day the goods reach us from our suppliers. However, goods dispatched after 3pm may not be collected until the following day. Please note that goods dispatched on a Friday will normally be delivered the following Monday. Goods dispatched on Saturday / Sunday will normally be delivered on the following Tuesday. Orders sent via this method will require a signature upon receipt.
Standard Airmail:

You will be charged a shipping cost for each item placed on your order. Upon entering the shipping country, deliveries will enter the postal system of the country concerned. It is our experience that goods delivered using this method arrive within 5-7 days of dispatch for European destinations, and within 7-10 days of dispatch for the Rest of the World.

Overseas Courier Delivery:
You will be charged a shipping cost for each item placed on your order. Orders will be dispatched using Royal mail. This method is fully secure, and we can track and trace the shipment for you. Orders placed by this method should reach you within 2-3 days of dispatch for European destinations, and within 3-5 days of dispatch for the Rest of the World. Orders sent via this method will require a signature upon receipt.

Paying by Credit or Debit Card:

Your account will not be debited until your order has been dispatched at which point our acceptance of your order takes place.
Please ensure that the expiry date on your payment card is after the anticipated dispatch date of your order as payment is taken on dispatch. If the card has expired we will be unable to ship your order.
